Access procedures for exercising the right

Art. 5 paragraph 1 of Legislative Decree 33/2013 provides for the obligation, provided for by current legislation for public administrations, to publish documents, information or data and involves the right of anyone to request the same, in cases where their publication has been omitted.
Accredited health facilities under contract with the Health Service are subject to the right of civic access in relation only to data, documents and information relating to the performance of health care activities.

The request must allow the structure to identify the data, document or information that is intended to be acquired; Generic requests are therefore inadmissible. In the event of a request relating to a manifestly unreasonable number of documents, such as to impose a workload likely to compromise the proper functioning of the health facility, the same may reject it to protect the smooth running of the administrative activity (National Anti-Corruption Agency – Anac Guidelines on generalized civic access, paragraph 4.2).

The right of generalized access is instead attributed by paragraph 2 of art. 5 d.lgs. 33/2013, for access to data and documents other than those subject to mandatory publication.
The exercise of this right, as for "civic" access, can also be exercised by anyone. Data and documents for which the limitations indicated in art. 5-bis of Legislative Decree no. 33/2013.
